A BILL to amend and reenact section nineteen, article nine, chapter
nine of the code of West Virginia, one thousand nine hundred
thirty-one, as amended, relating to the West Virginia works
program; and specifying additional areas of legislative
oversight.
Be it enacted by the Legislature of West Virginia:

That section nineteen, article nine, chapter nine of the code
of West Virginia, one thousand nine hundred thirty-one, as amended,
be amended and reenacted to read as follows:
ARTICLE 9. WEST VIRGINIA WORKS PROGRAM.
§9-9-19. Legislative oversight.

(a) The legislative oversight commission on health and human
resources accountability is charged with immediate and ongoing
oversight of the program created by this article. This commission shall study, review and examine the work of the program, the
department and its staff; study, review and examine all rules
proposed by the department; and monitor the development and
implementation of the West Virginia works program. The commission
shall review and make recommendations to the Legislature and the
legislative rule-making review committee regarding any plan, policy
or rule proposed by the secretary, the department or the program.

(b) The commission shall annually review and approve updates
to the state plan for the West Virginia works program, which shall
be submitted to the commission by the commissioner of the division
of human services before submission to the federal authorities.

(c) The commission shall recommend the use of particular
performance indicators and outcome measurements in order to
evaluate the effectiveness of the West Virginia works program.

(d) The commissioner of the division of human services shall
report monthly to the commission, except when the Legislature is in
regular session, with regard to case load, transfers of federal
funds, expenditures of federal funds and state maintenance of
effort moneys, as well as other areas, as determined by the
commission.

(e) The commissioner of the division of human services shall
file with the commission copies of all federal reports required under the temporary assistance for needy families program at the
same time such reports are filed with the federal authorities.

(f) The commissioner of the division of human services shall
submit all requests for proposals and bid requests issued under the
West Virginia works program to the commission for its review.

(g) The commissioner of the division of human services shall
submit to the commission on a monthly basis copies of all executed
contracts and grant awards funded with federal block grant moneys
or state maintenance of effort moneys under the temporary
assistance for needy families program, as well as all applications
for funding.

(h) The commissioner of the division of human services shall
provide to the commission on an annual basis a strategic spending
plan outlining the expenditure of the state's federal block grant
and state maintenance of effort moneys under the temporary
assistance for needy families program, and any amendments thereto.
